Yesterday, I posted about the Tea Party, and their interests in ripping several amendments out of the constitution, including the 14th amendment. The linked blog post is from a week ago, but I think it sheds some light on why the Tea Party is moving in the direction that it is. LGBTQ advocates who are seeking full equality do so, partly using the 14th amendment for justification. It isn’t news to anyone that a judge like Scalia feels as he does. He considers himself to be a strict constitutionalist, except when it doesn’t suit his ultra-conservative position (and then, he acts as an activist judge). Â But it ought to send shivers up your spine to realize that the Far Right knows that while they may not be able to kill Gay Rights via judges, they are also willing to kill it via gutting the Constitution. Speaking on Friday at the University of Richmond, Supreme Court Justice Antonin Scalia denounced the concept of a “living Constitution†and said the 14th Amendment was not written with the intent of granting equal protection to ALL Americans. Just the heterosexual ones.
Joe rightly points out that it isn’t only Gays that Scalia is aiming at. His interpretation of the Constitution also attacks Women’s Rights.
Some may believe that all of our collective gay, lesbian, bisexual, and transgender energy needs to go to gaining new rights. New in the sense that we now don’t have them, even though we deserve them and full equality. I would suggest equal time needs to go to just making sure there is a solid ground of diverse viewpoints upon which democracy and grow and thrive. We are losing our country to these crazies, and we need to realize it before it is too late. We want a few rights while they are destroying the very framework upon which any of us (all of us) have any rights at all.
